This protocol is to build a peaceful, safe, stable and prosperous cooperation area.
President Joko Widodo or Jokowi ratified Presidential Regulation or Presidential Regulation No. 81 of 2022. This regulation regulates the ASEAN Protocol on the enhanced dispute resolution mechanism, which has been signed by the Government of Indonesia since December 20, 2019 in Manila, Philippines.
"To build a peaceful, safe, stable, and prosperous cooperation area," reads the points of consideration in the Presidential Decree, which was signed by Jokowi on May 20, 2022.
This Presidential Regulation also attaches the original 76 pages of the protocol for cooperation between ASEAN countries. In total, there are 27 agreed articles in this protocol.
In this text it is stated that this Protocol was formed because ASEAN countries are aware of the need for special procedures for disputes. The dispute in question is one involving less developed ASEAN member countries.
In addition, this Protocol is here to enhance the ASEAN Protocol on enhanced dispute resolution mechanisms, which have already been regulated in Article 24 paragraph 3 of the ASEAN Charter.
As for Article 1 in this new Protocol, for example, it states that the rules and procedures in this Protocol must apply to disputes submitted under the provisions of consultation and dispute resolution in agreements made by member countries. The agreement covers many aspects, from the 105 various agreements that have been formed by ASEAM countries so far, as well as ASEAN economic agreements in the future.
However, the provisions of this Protocol do not reduce the right of member states to seek other forums for dispute resolution.
Furthermore, Article 2 of this Protocol also regulates the Senior Economic Officials Meeting (SEOM). Its job is to administer this protocol and the brief completion of the agreements it includes.
Furthermore, this Protocol regulates disputes that are resolved through a panel mechanism until the establishment of an Appeals Body by the Ministers of Economics of ASEAN Countries. Later, an official in the Appeals Body will be appointed who will serve for 4 years, and may be appointed again for another period. (antara, tempo)
